The terms that govern your use of better athlete.

1. Who we are

better athlete is a training-intelligence service for athletes ages 13–20 and the coaches, parents, and clinicians around them. We make movement readiness, recovery, and training signals visible so decisions get better, earlier.

2. Who may use this service

You may use this service if you are 13 years of age or older. If you are under 18, your parent or legal guardian must agree to these terms on your behalf. Persons under 13 are subject to additional requirements under the Children’s Online Privacy Protection Act (COPPA) — see our Privacy Policy for details.

You agree to provide accurate information and to keep it current. You may withdraw consent at any time by contacting privacy@betterathlete.com.

3. Acceptable use

You agree to use this service in compliance with applicable law. You will not:

• Attempt to reverse-engineer, decompile, or extract proprietary methodology from the service.
• Impersonate another user, share login credentials, or attempt to access data of athletes other than those for whom you are authorized.
• Upload content that violates anyone’s rights, violates law, or is harmful to others.
• Use the service to make medical decisions in lieu of qualified clinical evaluation.

4. Movement screening & recommendations

Any movement screening or readiness signal produced by this service is informational. It is not a diagnosis. Any clinical determination requires evaluation by a licensed healthcare provider. We are not responsible for the outcome of any clinical evaluation by any provider.

5. No medical advice

THE SERVICE DOES NOT PROVIDE MEDICAL ADVICE. Information from this service should not be used as a substitute for advice from a qualified medical provider. Always consult a clinician for medical conditions.

6. Intellectual property

better athlete owns the platform, software, methodology, branding, and content (other than what you submit). You retain ownership of content you submit. You grant better athlete a non-exclusive, limited license to use that content for the purpose of providing the service to you. Aggregate, de-identified data may be used to improve methodology and inform research collaborations.

7. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” To the maximum extent permitted by law, better athlete disclaims all warranties, express or implied. better athlete is not liable for indirect, special, incidental, consequential, or punitive damages. To the maximum extent permitted by law, better athlete’s aggregate liability arising from your use of the service will not exceed the lesser of (a) fees you paid in the prior twelve months, or (b) one hundred dollars ($100). Nothing in these terms limits liability for intentional misconduct, gross negligence, or any liability that cannot be excluded by applicable law.

8. Indemnification

You agree to indemnify and hold better athlete harmless from claims arising from your breach of these terms or violation of law.

9. Account termination

You may stop using the service at any time and request deletion of your account by emailing privacy@betterathlete.com. We may suspend or terminate your account for material breach of these terms or risk to the service or users.

10. Governing law & disputes

These terms are governed by the laws of the State of New York. Disputes are resolved by good-faith discussion first, then by binding arbitration in New York, New York, conducted under AAA Consumer Arbitration Rules. You may opt out of binding arbitration within 30 days of agreeing to these terms by emailing legal@betterathlete.com. You waive participation in class actions to the maximum extent permitted by law.

11. Changes to these terms

We may update these terms. We will notify you of material changes. Continued use after notification constitutes acceptance.
